When Unpaid Rent Starts Becoming a Bigger Problem


Unpaid rent doesn’t usually hit all at once. More often, it builds up over time. A payment comes in late, then the next one is delayed a bit longer, and before you know it, there’s a gap that hasn’t been filled.

At first, most landlords will try to keep things simple. A reminder, a quick call, maybe a chat to understand what’s going on. And in fairness, that does work sometimes. If the tenant is open and it’s just a short-term issue, things can settle without much trouble.

It’s when that stops happening that things start to shift. That’s usually the point where it stops being a one-off delay and starts turning into something more difficult to manage.

That’s when landlords often begin looking at other options. Not because they want to make things difficult, but because the usual approach isn’t getting results.

One of those options is something called Commercial Rent Arrears Recovery, or CRAR for short. It’s a formal way of dealing with unpaid rent on commercial properties, where the tenant is still using the space.

It’s not something that applies to every situation. It only works for fully commercial properties, and there needs to be a written agreement in place. That catches some people out, especially if the setup isn’t completely straightforward.

Before anything happens, the tenant is given notice. Think of it as a final opportunity to put things right before it goes any further. In a lot of cases, that alone is enough to get things moving again. Once it’s clear the situation isn’t just being left, people tend to respond.

If it does move forward, enforcement agents can attend the property and take control of certain goods. There are limits around what can and can’t be taken, and it all has to be handled properly.

Interestingly, it doesn’t always get that far. Quite often, the process itself is enough to change the tone. What was being delayed or avoided suddenly gets attention again.

Timing plays a bigger role than people expect. The longer things are left, the harder they can become to sort out. What might have been a relatively simple situation early on can become more complicated if it drags on.
